Arbitration and Litigation

KBA’s principal practice further encompasses providing legal advice in major domestic and international arbitration and court proceedings and protection of foreign investments. KBA’s lawyers have extensive experience litigating and advising clients with respect to arbitration proceedings in both Czech as well as foreign jurisdictions.

We have extensive experience in securities and shareholder litigation, BIT litigation, general commercial litigation, litigation related to the protection of goodwill and unfair competition and regulatory investigations.

Selected engagements of the firm in which KBA’s lawyers have been involved in the field of Arbitration and Litigation include:

  • Series of investment disputes led by Central European Media Enterprises (CME) and its owner against the Czech Republic under the Treaty on Protection of Investment between the Netherlands and the Czech Republic and the Treaty on Protection of Investment between the United States and the Czech Republic, in accordance with the UNCITRAL rules. The damages awarded amounted to USD 355 million.
  • Series of arbitration and court disputes led by CME Group companies against Mr. Železný, involving arbitration proceedings before the Arbitration Court of the International Chamber of Commerce (ICC) concerning a dispute arising from a Czech law contract, including a USD 28 million enforcement in the Czech Republic of the ICC arbitration award based on the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards.
  • Successful representation of European Bank for Reconstruction and Development (EBRD) and three other shareholders of KORADO, a.s., a major European producer of radiators, as defendants in an international arbitration in London under the UNCITRAL rules regarding the ownership of KORADO against the claimant, Mr. Brabec, whose claims were dismissed in their entirety.
  • Successful representation of Plzeňský Prazdroj, a.s. (Pilsner Urquell) and provision of Czech law advice to a leading Swiss law firm, Bär & Karrer, in arbitration proceedings in Zürich under the Rules of the Arbitration Court of the Chamber of Commerce of the Cantone Ticino, Switzerland, against the claims of Niamares S.A.
  • Representation of CET 21 spol. s r.o., as the claimant in pending court proceedings against the Council for Radio and Television Broadcasting in the Czech Republic in connection with actions challenging the decisions of the Council regarding the granting of licenses for terrestrial digital TV broadcasting.
  • Successful representation of Jyxo, s.r.o., an information technology provider and operator in a dispute regarding unfair competition and rights related to trademarks and goodwill.
  • Successful representation of KORADO, a.s. in material labor disputes involving key personnel of the company.
